A newly filed class-action lawsuit accuses \u0438\u043d\u0432\u0435\u0441\u0442\u0438\u0446\u0438\u0438 \u0432 \u0434\u043e\u043c\u0430\u0448\u043d\u0438\u0439 \u043a\u0430\u043f\u0438\u0442\u0430\u043b<\/a> (HEI) company \u0423\u043d\u0438\u0441\u043e\u043d<\/strong> of misleading homeowners and structuring its products in ways that leave customers with far less equity than expected.<\/p>\n

The complaint, filed April 6 in the U.S. District Court for the District of Colorado<\/strong> by plaintiffs Katharine and Charles Kane, alleges that \u0423\u043d\u0438\u0441\u043e\u043d<\/a> and affiliated entities deceptively market their home equity agreements as a simple, debt-free alternative to loans.<\/p>\n

At the heart of the lawsuit, the Kanes are challenging Unison\u2019s core product, which provides homeowners with an upfront cash payment in exchange for a share of the home\u2019s future value, alleging that they are \u201ctrapped\u201d in the agreement.<\/p>\n

\u201cAs of March 31, 2026, Unison estimates the Kanes will owe up to $278,618 to terminate the contract, when they were advanced just over $87,000 after fees at the start of their agreement,\u201d the suit says. <\/p>\n

According to the lawsuit, Unison offers homeowners an upfront cash payment in exchange for a share of the home\u2019s future value. The company promotes the product as having \u201cno debt,\u201d \u201cno interest\u201d and no monthly payments<\/a>, while positioning itself as a \u201cpartner\u201d that shares in both gains and losses.<\/p>\n

The plaintiffs argue that these claims are misleading and that the product creates debt.<\/p>\n

\u201cThe Unison transaction is a residential mortgage loan because it provides homeowners an upfront payment that at least most of the time, the homeowner will have to repay to Unison,\u201d the suit claims. <\/p>\n

Unison did not respond to \u0416\u0438\u043b\u044c\u0435\u041f\u0440\u043e\u0432\u043e\u043b\u043e\u043a\u0430<\/strong>\u2018s request for comment in time for publication. <\/p>\n

Singleton Schreiber<\/strong>, a law firm representing the plaintiffs in the case, issued a statement through senior counsel Elizabeth Aniskevich in which it labeled Unison\u2019s products as \u201cpredatory.\u201d<\/p>\n

\u201cUnison intentionally misled homeowners to avoid\u00a0the consumer\u00a0protection, mortgage lending, and credit disclosure laws that exist precisely to protect people like our clients,\u201d Aniskevich said. \u201cHomeowners are handed\u00a0nearly 100\u00a0pages of complex documents, often for the first time,\u00a0at a closing that moves quickly and without any Unison representative present to explain what they are signing. <\/p>\n

\u201cThe promises that drew them in, no debt, no interest, a financial \u2018partner\u2019, all prove to be false when the agreement\u00a0concludes\u00a0and a massive repayment bill comes due. These\u00a0aren\u2019t\u00a0technical\u00a0violations,\u00a0they reflect a business model built on keeping borrowers in the dark. We intend to hold Unison accountable and ensure \u041a\u043e\u043b\u043e\u0440\u0430\u0434\u043e<\/a> homeowners get the protections the law guarantees them.\u201d\u00a0<\/p>\n

The lawsuit contends the agreements function as loans that ultimately require repayment of the initial cash amount plus what amounts to interest, often through a large lump-sum payment at the end of the term. In many cases, the filing alleges, homeowners must sell their homes to satisfy the obligation.<\/p>\n

\u201cHomeowners will almost certainly be required to repay every penny they receive, plus interest in the form of a significant lump sum balloon payment,\u201d the complaint states.<\/p>\n

The suit also alleges that Unison structures its agreements to maximize its own returns while limiting risk. Among the practices cited are discounting a home\u2019s initial value, requiring homeowners to cover all property-related costs<\/a> during the agreement term, and maintaining control over the \u043e\u0446\u0435\u043d\u043a\u0430<\/a> process that determines the home\u2019s final value.<\/p>\n

As a result, the plaintiffs claim, homeowners may walk away from a home sale with little remaining \u043a\u0430\u043f\u0438\u0442\u0430\u043b<\/a> despite years of ownership.<\/p>\n

The complaint seeks class-action status on behalf of similarly situated homeowners and includes claims that the company\u2019s practices are deceptive and unfair.<\/p>\n

The case comes at a time when home equity investment companies are increasingly under scrutiny for what the lawsuit calls \u201ca deceptive\u201d practice.<\/p>\n

\u201cIn recent years, institutional and high-net-worth investors have been seeking a piece of that pie for themselves in ways that are increasingly deceptive and unfair to homeowners,\u201d the suit reads. <\/p>\n

This isn\u2019t Unison\u2019s first time in the legal hot seat. A \u043e\u0442\u0434\u0435\u043b\u044c\u043d\u044b\u0439 \u0438\u0441\u043a<\/a>, filed in September in the\u00a0Superior Court of California for the County of<\/strong>\u00a0\u0421\u0430\u043d-\u0424\u0440\u0430\u043d\u0446\u0438\u0441\u043a\u043e<\/strong>, alleges that Unison uses predatory equity-sharing contracts that function as unlicensed, high-interest mortgages disguised as investment partnerships.<\/p>\n

Lead plaintiff Patricia Gout, an 80-year-old retiree, said she received $97,256 from Unison in 2017 for home repairs<\/a> and medical expenses but later learned she owed nearly $375,000, an effective interest rate of about 34.5%.<\/p>\n

Other challenges against the company include a \u0410\u043f\u0435\u043b\u043b\u044f\u0446\u0438\u043e\u043d\u043d\u044b\u0439 \u0441\u0443\u0434 \u0434\u0435\u0432\u044f\u0442\u043e\u0433\u043e \u043e\u043a\u0440\u0443\u0433\u0430<\/strong> ruling in Olson v. Unison<\/a> that found its product functioned as a reverse mortgage under Washington state law and involved deceptive marketing practices.<\/p>\n

Although Unison settled that case in October 2025, it also faces a \u043e\u0442\u0434\u0435\u043b\u044c\u043d\u044b\u0439 \u0438\u0441\u043a<\/a> \u0438\u0437 National Association of Consumer Advocates<\/strong> alleging the company misrepresents its product as a no-debt home equity option.<\/p>\n

Other companies in the space are under scrutiny as well. Hometap<\/strong> was sued in Massachusetts, where Attorney General Andrea Joy Campbell \u0443\u0442\u0432\u0435\u0440\u0436\u0434\u0430\u043b<\/a> the company\u2019s product violates state usury laws.<\/p>\n

Unison, founded in the early 2000s, created its business model to give investors exposure to the U.S. home equity market without requiring them to directly own property.<\/p>\n
