{"id":62939,"date":"2026-05-01T03:05:02","date_gmt":"2026-05-01T01:05:02","guid":{"rendered":"https:\/\/housesmarketplace.com\/hud-says-realtors-can-discuss-crime-and-school-data-reversing-biden-era-stance\/"},"modified":"2026-05-01T03:05:02","modified_gmt":"2026-05-01T01:05:02","slug":"hud-says-realtors-can-discuss-crime-and-school-data-reversing-biden-era-stance","status":"publish","type":"post","link":"https:\/\/housesmarketplace.com\/ru\/hud-says-realtors-can-discuss-crime-and-school-data-reversing-biden-era-stance\/","title":{"rendered":"HUD says Realtors can discuss crime and school data, reversing Biden-era stance"},"content":{"rendered":"<div>\n<p>Real estate agents may lawfully discuss neighborhood crime rates and school quality with clients without violating the Fair Housing Act\u2019s prohibition on racial steering, the <strong>\u041c\u0438\u043d\u0438\u0441\u0442\u0435\u0440\u0441\u0442\u0432\u043e \u0436\u0438\u043b\u0438\u0449\u043d\u043e\u0433\u043e \u0441\u0442\u0440\u043e\u0438\u0442\u0435\u043b\u044c\u0441\u0442\u0432\u0430 \u0438 \u0433\u043e\u0440\u043e\u0434\u0441\u043a\u043e\u0433\u043e \u0440\u0430\u0437\u0432\u0438\u0442\u0438\u044f \u0421\u0428\u0410 <\/strong>(<a href=\"https:\/\/www.housingwire.com\/articles\/hud-rescinds-iecc-rule\/\">HUD<\/a>) announced April 24. \u00a0<\/p>\n<p>The move reverses guidance that\u2019s led major industry players to remove or restrict such information.<\/p>\n<p>New guidance, issued in a letter by HUD\u2019s Office of Fair Housing and Equal Opportunity, directly contradicts years of industry practice during the Biden administration. \u00a0<\/p>\n<p><a href=\"https:\/\/www.hud.gov\/sites\/default\/files\/hudclips\/documents\/AS-Trainor%27s-DCL-on-Neighborhood-Crime-Data-and-School-Quality.pdf\">The letter<\/a> names <strong>\u0420\u0438\u044d\u043b\u0442\u043e\u0440.com<\/strong>, <strong>\u041a\u0440\u0430\u0441\u043d\u043e\u043f\u0435\u0440\u044b\u0439<\/strong> \u0438 <strong>\u0422\u0440\u0443\u043b\u0438\u044f<\/strong> as having removed crime data from their platforms, citing concerns of racial bias.<\/p>\n<p>It also accuses the <strong><a href=\"https:\/\/www.housingwire.com\/articles\/nar-wright-transparency-antitrust\/\">\u041d\u0430\u0446\u0438\u043e\u043d\u0430\u043b\u044c\u043d\u0430\u044f \u0430\u0441\u0441\u043e\u0446\u0438\u0430\u0446\u0438\u044f \u0440\u0438\u044d\u043b\u0442\u043e\u0440\u043e\u0432<\/a><\/strong> (NAR) of imposing a \u201cprofessional gag order\u201d on its members.<\/p>\n<p>\u201cContrary to publicly available materials from industry leaders on steering, real estate agents and brokers do not violate the Fair Housing Act merely by discussing with prospective homebuyers or renters the prevalence of crime or the quality of schools in neighborhoods,\u201d HUD assistant secretary Craig Trainor wrote.<\/p>\n<p>The guidance was prompted by President <a href=\"https:\/\/www.housingwire.com\/articles\/trump-state-of-the-union-offers-few-housing-details\/\">Donald Trump\u2019s<\/a> recent executive order, <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/04\/restoring-equality-of-opportunity-and-meritocracy\/\">\u201cRestoring Equality of Opportunity and Meritocracy,\u201d<\/a> which Trainor said superseded Biden-era policies.<\/p>\n<p>\u201cRemoving crime data does not help Americans make \u2018informed decisions\u2019 about where to buy a home. It achieves the opposite effect,\u201d he wrote.<\/p>\n<p>Under the Fair Housing Act, racial <a href=\"https:\/\/www.housingwire.com\/articles\/inside-the-governments-feeble-fight-to-end-redlining\/\">\u0440\u0443\u043b\u0435\u0432\u043e\u0435 \u0443\u043f\u0440\u0430\u0432\u043b\u0435\u043d\u0438\u0435<\/a> is defined as \u201cdirecting prospective homebuyers interested in equivalent properties to different areas according to their race,\u201d the letter stated.<\/p>\n<p>Trainor emphasized that intent is key.<\/p>\n<p>\u201cStatements made without the intent to direct a client based on his race or the prevailing racial characteristics of a neighborhood do not constitute unlawful racial steering,\u201d he wrote.<\/p>\n<p>The letter explicitly warns that state and local fair housing agencies receiving federal funds \u201cshould not issue findings of discrimination based on real estate professionals providing school and crime data to customers in an equal and consistent manner.\u201d<\/p>\n<p>Language also cited 2023 advice from NAR telling members they could be \u201cinadvertently steering clients\u201d by answering questions about schools \u2014 and that \u201cimplicit bias might inadvertently lead to <a href=\"https:\/\/www.housingwire.com\/articles\/hud-equal-access-rule\/\">\u0441\u043f\u0440\u0430\u0432\u0435\u0434\u043b\u0438\u0432\u043e\u0435 \u0436\u0438\u043b\u044c\u0435<\/a> violations.\u201d<\/p>\n<p>Trainor called those statements \u201cmisguided.\u201d<\/p>\n<p>\u201cIndustry guidance instructing Realtors not to answer client questions related to crime or schools does a disservice to purchasers, renters, <a href=\"https:\/\/www.housingwire.com\/articles\/better-client-meeting-15-min\/\">\u0440\u0438\u0435\u043b\u0442\u043e\u0440\u044b<\/a> and fair housing principles,\u201d he wrote.<\/p>\n<p>HUD is now urging real estate organizations to \u201crevisit ethics training materials\u201d and reconsider statements that perceived to \u201cstifle agent speech.\u201d<\/p>\n<p>NAR did not immediately respond to <strong>\u0416\u0438\u043b\u044c\u0435\u041f\u0440\u043e\u0432\u043e\u043b\u043e\u043a\u0430<\/strong>\u0437\u0430\u043f\u0440\u043e\u0441 \u043d\u0430 \u043a\u043e\u043c\u043c\u0435\u043d\u0442\u0430\u0440\u0438\u0439.<\/p>\n<\/div>","protected":false},"excerpt":{"rendered":"<p>Real estate agents may lawfully discuss neighborhood crime rates and school quality with clients without violating the Fair Housing Act\u2019s prohibition on racial steering, the U.S. Department of Housing and Urban Development (HUD) announced April 24. \u00a0 The move reverses guidance that\u2019s led major industry players to remove or restrict such information.
