{"id":63099,"date":"2026-05-22T03:00:18","date_gmt":"2026-05-22T01:00:18","guid":{"rendered":"https:\/\/housesmarketplace.com\/the-mred-zillow-legal-fight-just-hit-agents-and-sellers-directly\/"},"modified":"2026-05-22T03:00:18","modified_gmt":"2026-05-22T01:00:18","slug":"the-mred-zillow-legal-fight-just-hit-agents-and-sellers-directly","status":"publish","type":"post","link":"https:\/\/housesmarketplace.com\/ru\/the-mred-zillow-legal-fight-just-hit-agents-and-sellers-directly\/","title":{"rendered":"The MRED Zillow legal fight just hit agents and sellers directly"},"content":{"rendered":"<div>\n<p>Real estate professionals across the Greater Chicagoland area awoke Wednesday to find their <a href=\"https:\/\/www.housingwire.com\/articles\/mred-suspends-zillow-feed\/\" target=\"_blank\" rel=\"noreferrer noopener\">listings removed<\/a> \u043e\u0442<strong> \u0417\u0438\u043b\u043b\u043e\u0443<\/strong>, as the fight between the listing portal giant and the local MLS, <strong>\u0414\u0430\u043d\u043d\u044b\u0435 \u043e \u043d\u0435\u0434\u0432\u0438\u0436\u0438\u043c\u043e\u0441\u0442\u0438 \u0421\u0440\u0435\u0434\u043d\u0435\u0433\u043e \u0417\u0430\u043f\u0430\u0434\u0430 <\/strong>(MRED), which already includes an <a href=\"https:\/\/www.housingwire.com\/articles\/zillow-mred-compass-lawsuit\/\" target=\"_blank\" rel=\"noreferrer noopener\">antitrust lawsuit,<\/a> escalated.\u00a0<\/p>\n<p>On Wednesday morning, MRED announced that it was suspending listing data feeds to Zillow and <strong>\u0422\u0440\u0443\u043b\u0438\u044f<\/strong> after the portal allegedly refused to cure what the MLS called a \u201cmaterial breach\u201d of its license agreements. MRED claims that, according to its licensing agreement with Zillow, the portal must display all of the listings MRED supplies it with. However, Zillow\u2019s<a href=\"https:\/\/www.housingwire.com\/articles\/zillows-pre-emptive-strike-on-private-listings\/\" target=\"_blank\" rel=\"noreferrer noopener\"> Listing Access Standards policy<\/a> bans listings that are publicly marketed for more than one day before being available for display on sites powered by <a href=\"https:\/\/www.housingwire.com\/articles\/zillow-rolls-out-vow-site-to-supplement-idx-feeds\/\" target=\"_blank\" rel=\"noreferrer noopener\">IDX or VOW data feeds<\/a>, which resulted in nine listings in MRED\u2019s data set being banned from Zillow.<\/p>\n<p>Due to this, MRED pulled over 40,000 listings from Zillow, despite the portal asking the court in its antitrust lawsuit to <a href=\"https:\/\/www.housingwire.com\/articles\/zillow-injunction-mred-cutoff\/\" target=\"_blank\" rel=\"noreferrer noopener\">stop MRED<\/a> from taking this action.<\/p>\n<p>As of Thursday morning, Zillow showed roughly 1,900 homes for sale in Chicago, compared to over 8,600 on <strong>\u0420\u0438\u044d\u043b\u0442\u043e\u0440.com<\/strong> and over 5,000 on <strong>\u041a\u0440\u0430\u0441\u043d\u043e\u043f\u0435\u0440\u044b\u0439<\/strong>.\u00a0<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-agents-in-the-middle\">Agents in the middle<\/h2>\n<p>MRED\u2019s decision to pull its listings has left thousands of agents in the middle of this dispute, forcing them to explain to their clients why their listing may not be on Zillow and why they won\u2019t be able to see the area\u2019s available inventory on Zillow.\u00a0<\/p>\n<p>\u201cIt\u2019s not lost on me there is a long history and genuine complexities in [this] battle. My frustration is that it\u2019s working agents and home sellers who are paying the price with MRED cutting their feed to Zillow,\u201d Nick Aufenkamp, the founder of <strong>DIY Homebuyer Academy <\/strong>and a Washington-based broker, wrote in an email. \u201cIf I\u2019m selling my home in Chicagoland, I want it to be as visible and accessible to as many potential buyers as possible. As the seller, I do not care what my agent or their brokerage feels about Zillow and how they monetize leads. I just know that more potential homebuyers search on Zillow than anywhere else. Because it\u2019s the biggest marketplace today, that\u2019s where I want my home to show up above all else.\u201d<\/p>\n<p>As Carrie McCormick, a Chicago-based luxury-focused agent at <strong>@\u0445\u0430\u0440\u0430\u043a\u0442\u0435\u0440\u0438\u0441\u0442\u0438\u043a\u0438<\/strong> sees it, \u201cthe main issue is making sure things stay clear and consistent for buyers and sellers.\u201d<\/p>\n<p>\u201cReal estate is already a complicated process, and when listing visibility or data sharing changes between platforms, it can create confusion around what\u2019s actually available, where homes are being marketed and how that affects exposure and value,\u201d McCormick wrote in an email.<\/p>\n<p>With her clients, McCormick said her focus is always on ensuring that they understand \u201cwhere and how their property is being promoted, getting the right level of exposure and adjusting the strategy as the market continues to evolve.\u201d<\/p>\n<p>\u201cEspecially in the luxury space, sometimes a more private or targeted approach can actually work better, while other properties benefit most from broad public exposure. It really depends on the property and the client\u2019s goals,\u201d she wrote.\u00a0<\/p>\n<p>She added that for most sellers, getting as much visibility as possible is often key for driving interest in a property and that disconnects, like this one between MRED and Zillow, can impact how easily buyers are finding listings.<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-a-direct-feed-to-zillow\">A direct feed to Zillow<\/h2>\n<p>While MRED has pulled its listings from Zillow, brokerage leaders do have the option of providing Zillow with a direct feed of their listings outside of the MLS.\u00a0<\/p>\n<p><strong>Compass International Holdings<\/strong>, which is the second defendant in Zillow\u2019s antitrust lawsuit against MRED and the parent company of McCormick\u2019s broker @properties, said on Thursday that it would not be providing Zillow with a direct listing feed. In<a href=\"https:\/\/www.linkedin.com\/posts\/robertreffkin_why-compass-international-holdings-will-not-share-7463188737334706176--Bpo?utm_source=share&amp;utm_medium=member_desktop&amp;rcm=ACoAAC_yWIoBP0EBi01DxhDSINs6QEwKTapmPmY\" target=\"_blank\" rel=\"noreferrer noopener\"> \u043f\u043e\u0441\u0442<\/a> on LinkedIn, Compass CEO Robert Reffkin wrote that his firm made this decision because the \u201cway we can protect our clients\u2019 data is if it\u2019s entered securely into the MLS or directly into our platform.\u201d<\/p>\n<p>\u201cUnder Illinois law, brokerages are responsible for supervising how listings are marketed to consumers, and directly submitting listings to Zillow creates legal and regulatory risk for both the brokerage and agents,\u201d Reffkin wrote. \u201cSpecifically, Illinois law prohibits advertising, \u2018whether in print, via the Internet, or through social media, digital forums, or any other media\u2019 that is \u2018fraudulent, deceptive, inherently misleading, or proven to be misleading in practice.\u2019\u201d\u00a0<\/p>\n<p>Regarding this, he noted that Zillow is currently facing a <a href=\"https:\/\/www.housingwire.com\/articles\/zillow-respa-lawsuit-dismissal\/\" target=\"_blank\" rel=\"noreferrer noopener\">RESPA lawsuit <\/a>accusing it of deceptive marketing.\u00a0<\/p>\n<p>In an emailed statement, a Zillow spokesperson claimed that this post was and example of  Compass leadership moving \u201cfrom lying to Compass agents (well-documented in federal court) to lying to agents at other brokerages.\u201d<\/p>\n<p>\u201cThis is nonsense. The real reason Compass isn\u2019t putting its sellers\u2019 listings on Zillow \u2014 and the reason they orchestrated the feed cut with MRED \u2014 is because they don\u2019t want to have to compete. And now that other brokers are setting up direct listing feeds so their sellers can keep reaching Zillow\u2019s audience, Compass is coming up with new spin to try to scare them out of it,\u201d the spokesperson wrote. \u201cReffkin is starting to realize that sellers want their listings to be broadly available, and he doesn\u2019t want that to get in the way of his conspiracy. If Compass truly cared about \u2018seller choice,\u2019 they would want sellers to be able to choose to reach more buyers. Instead, they colluded with the local MLS to take seller choice away.\u201d<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-berkshire-exp-go-the-direct-listing-route\">Berkshire, eXp go the direct listing route<\/h2>\n<p>But while McCormick\u2019s listings are not currently on Zillow, those of <strong>Berkshire Hathaway HomeServices Chicago<\/strong> agent Keith Brand are. This is because Berkshire Hathaway HomeServices already had a direct listing feed in place, so its listings in the Chicagoland area were not impacted.\u00a0<\/p>\n<p>\u201cIt doesn\u2019t really change anything for us \u2014 if anything it is a net positive for our sellers because it means more eyeballs on their listings,\u201d Brand said.\u00a0<\/p>\n<p>For him, the fact that his firm has this direct listing feed shows that Berkshire Hathaway HomeServices is more driven by brokerage operations and supporting consumers than trying to drive traffic and lead generation to the company\u2019s website.<\/p>\n<p>Like Berkshire Hathaway HomeServices, <strong>\u042d\u043a\u0441\u043f \u041d\u0435\u0434\u0432\u0438\u0436\u0438\u043c\u043e\u0441\u0442\u044c<\/strong> already had a direct listing feed agreement with Zillow, meaning its listing are also still appearing on the listing portal giant, despite MRED pulling its feed.<\/p>\n<p>\u201cWe built the backup plan. eXp won\u2019t let MLS politics disrupt its agents\u2019 business,\u201d <a href=\"https:\/\/www.housingwire.com\/articles\/exps-wendy-forsythe-on-how-women-can-break-into-the-c-suite\/\" target=\"_blank\" rel=\"noreferrer noopener\">Wendy Forsythe<\/a>, the chief marketing officer at eXp, wrote in <a href=\"https:\/\/www.linkedin.com\/posts\/wendyforsythe_leadership-consumerfirst-transparency-share-7462991921901117441-HlNs?utm_source=share&amp;utm_medium=member_desktop&amp;rcm=ACoAAC_yWIoBP0EBi01DxhDSINs6QEwKTapmPmY\" target=\"_blank\" rel=\"noreferrer noopener\">\u043f\u043e\u0441\u0442 <\/a>on LinkedIn. \u201cIf you search for properties for sale in Chicago on Zillow today you will still find eXp listings.<\/p>\n<p>\u201cIf an institution chooses to weaponize its data feed in a corporate dispute, our sellers won\u2019t lose visibility and our buyers won\u2019t lose inventory,\u201d she added. \u201cThe consumer\u2019s experience should never depend on which institutions are in a fight this week.\u201d<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-impact-is-varied\">Impact is varied<\/h2>\n<p>But while agents like Brand are not impacted by MRED pulling its listing feed, he noted that that may not be the case for other agents, including buyer\u2019s agents who rely on Zillow for lead generation.\u00a0<\/p>\n<p>\u201cThe interesting thing about this is it impacts everyone differently,\u201d Brand said. \u201cBut if you are a team, whose entire business model is catered toward lead generation through Zillow, this flips that model on its head.\u201d\u00a0\u00a0<\/p>\n<p>For agents and brokers trying to help clients understand what\u2019s happening, Aufenkamp noted that there are pathways for agents to have their listings added directly to Zillow and that they should \u201ctake this opportunity to reflect on the kind of marketplace they envision for the future and vote with their feet if their brokerage and MLSs aims do not align with their own vision for a fair and transparent housing market.\u201d<\/p>\n<p>To Aufenkamp, an agent\u2019s first priority should be to sell their client\u2019s home.\u00a0<\/p>\n<p>\u201cWhether they like it or not, Zillow is one of, if not the most, powerful marketing tool to get exposure for their seller\u2019s listing. For a brokerage\/agent to prioritize lead capture over market exposure seems to me to be a violation of fiduciary responsibility,\u201d he wrote. \u201cI think that\u2019s the tension a lot of agents and sellers in Chicagoland are feeling today.
