As a result, HEI providers like <strong>\u0423\u043d\u0438\u0441\u043e\u043d<\/strong> \u0438\u043c\u0435\u0442\u044c <a href=\"https:\/\/www.housingwire.com\/articles\/unison-class-action-home-equity\/\">faced class-action lawsuits<\/a> over allegedly deceptive practices.<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-definitions-and-oversight\">Definitions and oversight<\/h2>\n<p>Holly Spencer Bunting, a partner at law firm <strong>Mayer Brown<\/strong>, said states are moving in different directions as lawmakers and regulators attempt to define and oversee HEIs. <\/p>\n<p>\u201cIt\u2019s almost sort of like we have two sides of the coin right now,\u201d Bunting said in an interview with <strong>\u0416\u0438\u043b\u044c\u0435\u041f\u0440\u043e\u0432\u043e\u043b\u043e\u043a\u0430<\/strong>. \u201cSome state legislation that\u2019s pending is quite restrictive, and then other states recognize that the product is a viable product.\u201d<\/p>\n<p><a href=\"https:\/\/www.housingwire.com\/articles\/maine-first-state-law-home-equity-investment-loans\/\">Maine recently joined the short list<\/a> of states to formally address the products, Bunting said. Before legislation was enacted there, the state\u2019s mortgage regulator issued guidance that treated HEIs as mortgages and requiring licensing, an approach that was later incorporated into state law.<\/p>\n<p>Other states are considering similar measures. Bunting pointed out that Pennsylvania and North Carolina have pending legislation related to HEIs, although the proposals differ in scope.<\/p>\n<p>Bunting said North Carolina\u2019s proposal is particularly extensive and would classify HEIs as loans while imposing mortgage licensing requirements and additional restrictions. Pennsylvania\u2019s bill began as a narrow amendment to state usury laws but has since expanded to include consumer protection provisions similar to those adopted in Maine.<\/p>\n<p>Bunting\u2019s comments come just days after <a href=\"https:\/\/www.housingwire.com\/articles\/illinois-comprehensive-rules-shared-equity-products\/\">Illinois finalized<\/a> a comprehensive regulatory framework for shared equity products under its Residential Mortgage License Act.<\/p>\n<p>\u201cI think the industry is relatively pleased with the regulatory framework that has evolved in Illinois,\u201d she said, adding that for many HEI providers, \u201cit\u2019s not been a secret that they\u2019re happy to be regulated \u2026 as long as the regulations make sense for the product.\u201d<\/p>\n<p>A central focus of state legislation has been consumer protection, particularly around disclosures and ensuring borrowers understand the long-term implications of the agreements. Bunting said regulators have been influenced by stories of borrowers who say they were surprised by the contractual consequences of certain events, such as a sale or <a href=\"https:\/\/www.housingwire.com\/tag\/refinancing\/\">\u0440\u0435\u0444\u0438\u043d\u0430\u043d\u0441\u0438\u0440\u043e\u0432\u0430\u0442\u044c<\/a>.<\/p>\n<p>\u201cMy impression is that there\u2019s been enough consumer stories of surprise when an event happens under the terms of the contract, and the consumer claims to be surprised at what the results are,\u201d she said.<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-could-the-cfpb-get-involved\">Could the CFPB get involved?<\/h2>\n<p>States are also increasingly requiring <a href=\"https:\/\/www.housingwire.com\/articles\/hud-counseling-removal-risks\/\">\u043a\u043e\u043d\u0441\u0443\u043b\u044c\u0442\u0438\u0440\u043e\u0432\u0430\u043d\u0438\u0435<\/a> before consumers enter into HEI agreements. Maine mandates counseling, while similar requirements appear in pending legislation in Pennsylvania and North Carolina.<\/p>\n<p>Another emerging proposal would require consumers to have legal representation during the transaction process. That requirement appears in Maine\u2019s enacted law and North Carolina\u2019s pending legislation.<\/p>\n<p>\u201cI think that\u2019s intended to provide consumer protection in the course of origination of the product,\u201d Bunting said.<\/p>\n<p>At the same time, states are grappling with broader regulatory questions, including whether HEIs should fall under existing mortgage laws or operate under separate licensing systems.<\/p>\n<p>Connecticut and Illinois amended existing mortgage licensing laws to incorporate HEI-related provisions. <a href=\"https:\/\/www.housingwire.com\/articles\/massachusetts-hometap-lawsuit\/\">\u041c\u0430\u0441\u0441\u0430\u0447\u0443\u0441\u0435\u0442\u0441<\/a> lawmakers have introduced competing bills, one of which would create a separate regulatory framework specifically tailored to HEI companies. In Washington state, the <strong>\u0410\u043f\u0435\u043b\u043b\u044f\u0446\u0438\u043e\u043d\u043d\u044b\u0439 \u0441\u0443\u0434 \u0434\u0435\u0432\u044f\u0442\u043e\u0433\u043e \u043e\u043a\u0440\u0443\u0433\u0430<\/strong> <a href=\"https:\/\/www.housingwire.com\/articles\/washington-hei-reverse-mortgage-ruling\/\">ruled in October<\/a> that HEIs are reverse mortgages under state law<\/p>\n<p>Beyond formal legislation, many states are informally evaluating the products through conversations with lenders and regulators.
