Homebuyers in Florida have filed a lawsuit against \u041a\u043e\u043c\u043f\u0430\u0441<\/strong> challenging a transaction fee the brokerage charged them upon the close of their August 2024 home purchase.\u00a0<\/p>\n

Filed on Tuesday in Palm Beach County, Florida circuit court by plaintiffs Jeff and Melissa Efron, the suit accused Compass of \u201cunfair and deceptive business practices\u201d for allegedly uniformly charging \u201can undisclosed flat-fee to all \u0424\u043b\u043e\u0440\u0438\u0434\u0430<\/a> purchasing clients.\u201d The plaintiffs allegedly paid \u041a\u043e\u043c\u043f\u0430\u0441<\/a> $475 when their transaction closed. The Efrons claim that the brokerage told them \u201cthat as the agents of the buyers, their efforts would be paid from the commission paid by sellers.\u201d<\/p>\n

The plaintiffs go on to claim that the transaction fee they paid violates the Florida Consumer Collections Practices Act and the Florida Deceptive and Unfair Trade Practices Act because it is \u201cunreasonable, illegitimate, excessive \u2026 or were for services which were not performed.\u201d\u00a0<\/p>\n

In addition, the plaintiffs claim that the purchase contract they signed during their transaction was the standard purchase and sale agreement approved by Florida Realtors and the Florida Bar that had then been amended to include \u201cadditional terms.\u201d They argue that \u201cthe modification of a contract approved by the Florida Bar by a non-lawyer is the illegal practice of law.\u201d\u00a0<\/p>\n

The complaint goes on to claim that through these acts, Compass is \u201cscamming Floridians and is engaged in the unauthorized practice of law without a license.\u201d<\/p>\n

The plaintiffs are seeking damages in excess of $15,000 and they are seeking class action status for the suit, which would include all buyers who paid such a fee to Compass Florida between June 2022 and June of 2026.\u00a0<\/p>\n

Compass addressed the transaction fees it charges consumers in the firm\u2019s Q1 2026 earnings report<\/a>, in which Compass acknowledged them as a revenue stream, however the company did not disclose how much these fees were. Compass expanded these fees nationwide earlier this year, prior to this, they only applied in certain markets, including Florida.<\/p>\n

\u201cWe primarily generate revenue from our owned-brokerage business when we collect a share of the gross sales commissions that these real estate professionals earn from home sales and certain other fees, such as flat transaction commission fees,\u201d the earnings report states.\u00a0<\/p>\n

Compass did not immediately return \u0416\u0438\u043b\u044c\u0435\u041f\u0440\u043e\u0432\u043e\u043b\u043e\u043a\u0430<\/strong>\u0437\u0430\u043f\u0440\u043e\u0441 \u043d\u0430 \u043a\u043e\u043c\u043c\u0435\u043d\u0442\u0430\u0440\u0438\u0439.\u00a0<\/p>\n
