{"id":63506,"date":"2026-07-08T03:00:13","date_gmt":"2026-07-08T01:00:13","guid":{"rendered":"https:\/\/housesmarketplace.com\/zillow-mred-compass-await-ruling-in-chicagoland-mls-fight\/"},"modified":"2026-07-08T03:00:13","modified_gmt":"2026-07-08T01:00:13","slug":"zillow-mred-compass-await-ruling-in-chicagoland-mls-fight","status":"publish","type":"post","link":"https:\/\/housesmarketplace.com\/ru\/zillow-mred-compass-await-ruling-in-chicagoland-mls-fight\/","title":{"rendered":"Zillow, MRED, Compass await ruling in Chicagoland MLS fight"},"content":{"rendered":"<div>\n<p>The hearing regarding <strong>\u0417\u0438\u043b\u043b\u043e\u0443<\/strong>\u2019s motion for a <a href=\"https:\/\/www.housingwire.com\/articles\/zillow-injunction-mred-cutoff\/\" target=\"_blank\" rel=\"noreferrer noopener\">preliminary injunction<\/a> in its ongoing <a href=\"https:\/\/www.housingwire.com\/articles\/zillow-injunction-mred-idx-vow\/\" target=\"_blank\" rel=\"noreferrer noopener\">antitrust battle <\/a>\u0441 <strong>\u0414\u0430\u043d\u043d\u044b\u0435 \u043e \u043d\u0435\u0434\u0432\u0438\u0436\u0438\u043c\u043e\u0441\u0442\u0438 \u0421\u0440\u0435\u0434\u043d\u0435\u0433\u043e \u0417\u0430\u043f\u0430\u0434\u0430 <\/strong>(MRED) and <strong>Compass International Holdings<\/strong> may have concluded <a href=\"https:\/\/www.housingwire.com\/articles\/zillow-injunction-hearing-testimony\/\" target=\"_blank\" rel=\"noreferrer noopener\">last Thursday<\/a>, but the parties are still waiting for an answer.\u00a0<\/p>\n<p>This week, all three parties must file post-hearing briefs by Thursday with any replies to another party\u2019s brief due by the following Monday. But while last week\u2019s hearing primarily focused on Zillow\u2019s motion for a preliminary injunction that would prevent MRED from <a href=\"https:\/\/www.housingwire.com\/articles\/antitrust-mred-zillow-listings\/\" target=\"_blank\" rel=\"noreferrer noopener\">suspending its IDX and VOW listing data feeds to Zillow<\/a>, the greater lawsuit rests on Zillow\u2019s claim that MRED and Compass conspired to cut off the listing portal\u2019s access to the Chicagoland MLS listing feed. <\/p>\n<p>And it is this antitrust argument that Judge John Tharp will be examining when he rules on Zillow motion, as in order to be awarded a preliminary injunction, a plaintiff must show that it would be irreparably harmed without it and that it is likely to prevail at trial.<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-zillow-makes-its-case\">Zillow makes its case\u00a0<\/h2>\n<p>Over the course of the <a href=\"https:\/\/www.housingwire.com\/articles\/zillow-mred-injunction-hearing\/\" target=\"_blank\" rel=\"noreferrer noopener\">two-day hearing<\/a>, Zillow sought to show the court that MRED and Compass had worked together to suspend Zillow\u2019s listing feed. The listing portal argued that MRED \u201cchanged\u201d the \u201cobjective criteria\u201d participants are used to filter its IDX listing data to target Zillow and its l<a href=\"https:\/\/www.housingwire.com\/articles\/zillows-pre-emptive-strike-on-private-listings\/\" target=\"_blank\" rel=\"noreferrer noopener\">isting access standards policy <\/a>at the behest of Compass and that the MLS suspended Zillow\u2019s listing feed not because of a neutral rule violation, but because Zillow\u2019s policy threatened Compass\u2019s business model. <\/p>\n<p>Under Zillow\u2019s policy, listings are banned from Zillow if they are not available for display on IDX or VOW feed powered websites within one business day of the property being publicly marketed, which impacts listings Compass markets as<a href=\"https:\/\/www.housingwire.com\/articles\/compass-q1-2025-earnings-robert-reffkin-clear-cooperation\/\" target=\"_blank\" rel=\"noreferrer noopener\"> \u0447\u0430\u0441\u0442\u043d\u044b\u0435 \u044d\u043a\u0441\u043a\u043b\u044e\u0437\u0438\u0432\u044b<\/a> before taking them public via the MLS, as the firm advertises the existence of these listings in a \u201cblack box\u201d on its site.\u00a0\u00a0<\/p>\n<p>Zillow also argued that its policy is pro-competitive and good for consumers because it promoted transparency and provides consumers with access to all available inventory, while MRED\u2019s enforcement of its IDX display rule resulting in the suspension of Zillow\u2019s feed hurt consumers, reduced transparency and protects Compass from competition.\u00a0<\/p>\n<p>Zillow attempted to illustrate its arguments by <a href=\"https:\/\/www.housingwire.com\/articles\/zillow-mred-idx-vow-hearing\/\" target=\"_blank\" rel=\"noreferrer noopener\">showing communications <\/a>between Compass and MRED leaders and questioning leaders at both firms about these communications.\u00a0<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-mred-claims-neutrality\">MRED claims neutrality<\/h2>\n<p>MRED stressed that the its \u201c<a href=\"https:\/\/docs.mlsgrid.com\/recent-releases\/mred-idx-and-vow-rules-changes?utm_source=chatgpt.com\" target=\"_blank\" rel=\"noreferrer noopener\">objective criteria<\/a>\u201d rule is neutral and the result of the\u00a0 <a href=\"https:\/\/www.housingwire.com\/articles\/doj-sues-national-association-of-realtors-for-alleged-antitrust-violations\/\" target=\"_blank\" rel=\"noreferrer noopener\">2008 settlement <\/a>\u043c\u0435\u0436\u0434\u0443 <strong>\u0414\u0435\u043f\u0430\u0440\u0442\u0430\u043c\u0435\u043d\u0442 \u043f\u0440\u0430\u0432\u043e\u0441\u0443\u0434\u0438\u044f<\/strong> (\u041c\u0438\u043d\u0438\u0441\u0442\u0435\u0440\u0441\u0442\u0432\u043e \u044e\u0441\u0442\u0438\u0446\u0438\u0438) \u0438 <strong>\u041d\u0430\u0446\u0438\u043e\u043d\u0430\u043b\u044c\u043d\u0430\u044f \u0430\u0441\u0441\u043e\u0446\u0438\u0430\u0446\u0438\u044f \u0440\u0438\u044d\u043b\u0442\u043e\u0440\u043e\u0432 <\/strong>(NAR), that prevented MLSs from selectively hiding listings from consumer-facing web portals and not concerted action with Compass. Under the policy, IDX participants may filter listings only using objective criteria, such as geography, price, property type and listing type. However, according to MRED\u2019s arguments, Zillow was filtering listings based on marketing history, which is not one of the criteria allowed under the policy.\u00a0<\/p>\n<p>\u041a\u0440\u043e\u043c\u0435 \u0442\u043e\u0433\u043e, <a href=\"https:\/\/www.housingwire.com\/articles\/46260-women-of-influence-rebecca-jensen\/\" target=\"_blank\" rel=\"noreferrer noopener\">Rebecca Jensen<\/a>, MRED\u2019s CEO, noted in her testimony that MRED has been working toward expanding nationally since she<a href=\"https:\/\/www.housingwire.com\/articles\/32571-rebecca-jensen-named-president-ceo-of-midwest-real-estate-data\/\" target=\"_blank\" rel=\"noreferrer noopener\"> took the helm at the MLS over a decade ago <\/a>and that these aspirations did not simply come about because Compass offered a pathway toward rapid national expansion.\u00a0<\/p>\n<p>Testimony also showed that in the view of the Chicagoland MLS, Zillow, not Compass, is the one attempting to dictate industry policy through its listing access standards.\u00a0<\/p>\n<p>Jensen also said she was \u201cdisgusted\u201d by Zillow\u2019s admission in planning documents that it knew that its listing access standards policy may violate the IDX display rules of some MLSs, yet they went through with deploying the policy anyway.<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-who-is-the-anticompetitive-one\">Who is the anticompetitive one?<\/h2>\n<p>As for Compass, the Robert Reffkin-helmed firm also pushed back on Zillow\u2019s claims that it conspired with MRED, with its attorney arguing that Compass acted unilaterally and lawfully when it complained to MRED and other MLSs about Zillow\u2019s listing bans. During his testimony on Thursday, Reffkin said that Zillow executives repeatedly said they would not allow brokers to market listings outside Zillow and that Zillow offered Compass financial incentives if it stopped promoting off-portal marketing strategies. <\/p>\n<p>He also testified that Zillow executives warned they would use \u201c<a href=\"https:\/\/www.housingwire.com\/articles\/compass-zillow-antitrust-hearing\/\" target=\"_blank\" rel=\"noreferrer noopener\">carrots and sticks<\/a>\u201d to stop marketing outside Zillow. Reffkin argued that this was anticompetitive as it sought to protect Zillow\u2019s business model while harming others businesses.\u00a0<\/p>\n<p>The brokerage defendant also argued that Zillow\u2019s policy not only interferes with a seller\u2019s ability to choose how they market a property, but also does not increase listing transparency, as the firm claims the policy punishes competing public marketplaces rather than hidden listings.\u00a0<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-the-waiting-game\">The waiting game<\/h2>\n<p>Judge Tharp will take all of these arguments as well as those outlined in the post-hearing motions and replies all parties will file by next Monday.
