Although a date has been set for a final approval hearing, the real estate brokerages and associations that settled the homebuyer \u043a\u043e\u043c\u0438\u0441\u0441\u0438\u043e\u043d\u043d\u044b\u0435 \u0438\u0441\u043a\u0438 <\/a>through the Tuccori suit\u2019s opt-in settlement <\/a>may still face some challenges.\u00a0<\/p>\n

The latest of these challenges is that earlier this week by four retired federal judges Diane Wood, David Coar, G. Patrick Murphy and Nancy Gertner challenged the settlements. In the filing, the retired judges, who collectively claim nearly 70 years of experience overseeing federal lawsuits, argue that if these opt-in settlements are approved it will encourage defendants in other class-action lawsuits to \u201cforum shop\u201d when looking to settlement.\u00a0<\/p>\n

The retired judges are urging the Seventh Circuit Court of Appeals to reverse the district court\u2019s decision to reject the Batton homebuyer commission lawsuit plaintiffs\u2019 attempt to intervene<\/a> in the Tuccori suit over their objections to these settlements. Judge Lindsay Jenkins, the federal court judge overseeing the Tuccori lawsuit, \u043f\u043e\u0441\u0442\u0430\u043d\u043e\u0432\u0438\u043b <\/a>that if the Batton plaintiffs wished to object to the Tuccori settlements they could object to them in person at the fairness hearing.\u00a0<\/p>\n

In the filing, the retired judges go on to argue that the district court judge\u2019s handling of this situation impacts the fairness of the process, stating that the Batton plaintiffs should be allowed to intervene in the Tuccori suit and present their objections.\u00a0<\/p>\n

\u201cThe district court treated his structural challenge as ordinary,\u201d the amicus filing states. \u201cBut an objection at the final approval hearing is not well-suited to testing whether the settlement forum itself was chosen to avoid adverse rulings, whether the deal reflects reverse-auction dynamics, or whether the opt-in settlement process undermines the coordination tools federal courts use to manage overlapping litigation.\u201d<\/p>\n

A reversal spells trouble for defendants<\/h2>\n

If the appeals court chooses to consider the retired judges\u2019 filing and reverses the district court\u2019s ruling, this could potentially spell trouble for defendants like the National Association of Realtors (<\/strong><\/a>NAR), \u041a\u043e\u043c\u043f\u0430\u0441<\/strong>, \u0425\u0430\u043d\u043d\u0430 \u0425\u043e\u043b\u0434\u0438\u043d\u0433\u0441<\/strong>, \u0414\u043e\u043c\u0423\u0441\u043b\u0443\u0433\u0438 \u0410\u043c\u0435\u0440\u0438\u043a\u0438<\/strong> \u0438 \u0412\u0435\u0437\u0434\u0435<\/strong>.\u00a0<\/p>\n

In an emailed statement, an NAR spokesperson told \u0416\u0438\u043b\u044c\u0435\u041f\u0440\u043e\u0432\u043e\u043b\u043e\u043a\u0430<\/strong> that the trade group \u201cstands by its proposed settlement, the process of which was approved by the District Court and included negotiations mediated by a retired Northern District of Illinois Chief Judge.\u201d\u00a0<\/p>\n

\u201cThe settlement seeks to resolve buyer-side commission litigation claims while offering meaningful protections across the industry. It provides a broad release for Realtor members, Realtor associations, MLSs, and those brokerages that meet the settlement\u2019s eligibility requirements,\u201d the spokesperson added. \u201cNAR continues to believe the settlement is fair, reasonable, and in the best interests of the class, and we will continue to defend it through the legal process.\u201d<\/p>\n

In the preliminary approval for the opt-in settlements, which was issued in May 2026, <\/a>Judge Jenkins wrote that the terms of the settlement, including the amount of each proposed opt-in agreement, are \u201cfair, reasonable and adequate.\u201d She ruled they were negotiated at arm\u2019s length by experienced counsel acting in good faith, including through multiple mediation sessions overseen by a court-appointed special master for mediation.<\/p>\n

She added that the opt-in agreements were \u201creached as a result of those negotiations; there has been adequate opportunity for experienced counsel to evaluate the claims and risks at this stage of the litigation; and the Court will likely be able to approve the Opt-In Agreements.\u201d\u00a0<\/p>\n
