Prebiotic soda brand Poppi is facing a lawsuit that claims the drinks may not actually provide any real gut health benefits.

Soda is not good for you, but prebiotic sodas are: At least that’s what we’ve been told about Poppi, one of the best-selling functional drinks, alongside other brands like Olipop and Wildwonder. Poppi is touted as an alternative to its less-healthy cousin, traditional sodas, and it claims to provide you with health and wellness benefits. However, that claim might not actually be true.

Last week, Kristin Cobbs of San Francisco filed a class action lawsuit against the company, which claims that Poppi actually isn’t particularly gut healthy at all. Poppi’s website says it’s made with fruit juice, apple cider vinegar, and inulin prebiotics—and prebiotics do help your gut.

“Prebiotics nurture a healthy gut environment, which is crucial for optimal health, since your microbiome is involved in nutrient absorption, regulating blood sugar and cholesterol levels, mood regulation, and immune functioning,” Samantha Cassetty, MS, RD, a plant-focused nutrition and wellness expert, has previously told Лучшие дома и сады.

The problem? Poppi only contains two grams of prebiotics per can, which according to the lawsuit, is “an amount too low to cause meaningful gut health benefits for the consumer from just one can.”

“Accordingly, a consumer would need to drink more than four Poppi sodas in a day to realize any potential health benefits from its prebiotic fiber,” the lawsuit reads. “However, even if a consumer were to do this, Poppi’s high sugar content would offset most, if not all, of these purported gut health benefits.”

Cobbs said she purchased the sodas because of the label, which features the slogan: “Be Gut Healthy. Be Gut Happy.” She argues that they didn’t improve her gut health at all—and might have had the opposite effect. 

“Ms. Cobbs, however, did not receive the benefit of her bargains because the Products did not, in fact, contain enough ‘prebiotics’ to achieve any meaningful ‘gut health,’” the lawsuit reads. “Likewise, Ms. Cobbs was unaware that excessive consumption of the Products could negatively impact her health. Had Ms. Cobbs known that Defendant’s representations and warranties about the Products were false, she would not have purchased the Products or would have paid substantially less for them.”

The lawsuit “demands” a trial by jury, as Cobbs is seeking monetary relief for herself and other customers who’ve had a similar experience.

In a response published on June 3, it appears Poppi isn’t backing down.

“We are on a mission to revolutionize soda for the next generation of soda drinkers, and we have diligently innovated to provide a tasting experience that millions of people have come to enjoy,” a statement from the company reads. “We believe the lawsuit is baseless, and we will vigorously defend against these allegations.”

To get the benefits of prebiotics for a healthier gut, experts recommend eating immune-boosting foods, like onions, garlic, asparagus, beans, black and green tea, apples, honey, and more. If you want to avoid added sugar, avoid the sodas—they shouldn’t be treated as a replacement or healthy alternative, according to functional medicine expert Jill Carnahan, MD in a prior interview with BHG.
